How Soon Can I Obtain a Pennsylvania No-Fault Divorce?

Separated Under two Years? A No-Fault Divorce Can Be Achieved in as Little as 90 Days

In Pennsylvania, spouses can file for a no-fault or a fault divorce. If the divorce is by "mutual consent," the court can grant a divorce 90 days after the complaint has been served upon the other party and both parties have filed the Affidavits of Consent.

Otherwise, if only one spouse wants a divorce and the other one is putting up a fight, the spouses must have been living "separate and apart" for at least two years, or two years must have passed since the divorce action was filed in order for the court to grant a divorce, based on a finding that the marriage was irretrievably broken. Both are considered "no-fault" divorce grounds.

As you can see, if you want a divorce, getting your spouse on board can mean the difference between 3 or 4 months and at least 2 years, and that's a big difference. There's no benefit in dragging out the inevitable.
